The Greenberg Glusker Consumer Claim Defense Group defends clients in the fields of e-commerce, fashion, food and beverage, consumer packaged goods, and retail from consumer claims including data privacy practices, disability access, false advertising, and consumer packaging.

Whether these claims are brought by bona fide public interest groups or plaintiff’s firms that target hundreds of businesses each year, we work with clients to prepare a strategy to effectively defend and resolve each claim so that their business can continue to grow.

Our litigation team focuses on resolving these claims early, quietly, and efficiently to minimize disruption to the business. In conjunction with defending these claims, Greenberg Glusker attorneys counsel clients on risk mitigation to avoid being targeted for consumer claims in the first place. Examples of claims include:

  • Defending consumer-facing businesses from Americans with Disabilities Act (ADA) and similar state law claims, including under the Unruh Act, alleging that their websites are inaccessible to the visually impaired.
  • Defending claims in court and arbitration alleging that clients’ data privacy and data analytics practices violate the California Invasion of Privacy Act (CIPA), federal wiretap law, and other state and federal privacy regulations.
  • Defending retail and e-commerce clients from claims alleging that their text message and email marketing practices violate the Telephone Consumer Protection Act (TCPA) and equivalent state laws.
  • Defending retail clients from claims under the Consumer Legal Remedies Act (CLRA) and Unfair Competition Law (UCL) alleging that advertisements and marketing materials contain false or misleading claims.
  • Defending consumer packaged goods clients from allegations of misleading packaging and health claims, including under the CLRA, UCL, and California Proposition 65.
  • Proactively counseling clients on their e-commerce, internet, marketing, and packaging practices to mitigate the risk of being targeted.
  • Advising clients on environmental marketing claims including sustainability claims and “green marketing” claims under federal and state law.
